How to fill in a Polish car sale agreement

Why the agreement is in Polish
When a car changes hands in Poland, the buyer takes the sale agreement to the vehicle registration office (wydział komunikacji) and uses it for the PCC tax return. Both offices work in Polish, and a contract in another language must come with a sworn translation (tłumaczenie przysięgłe), which costs time and money. That is why this tool fills in a standard Polish agreement while the form itself is in English. The agreement does not need a notary or witnesses - a written document signed by both parties is enough.
What a car sale agreement must contain
- date and place - official deadlines run from the date,
- the parties - full name, address, PESEL (or NIP for a business) and ID document number; foreigners without a PESEL can give a passport or residence card number,
- the vehicle - make, model, year, VIN, registration number, mileage and vehicle card number if one was issued,
- the price - in figures and in words, with the payment method and deadline,
- declarations - that the car is free of legal defects and that the buyer knows its technical condition,
- signatures of all owners and the buyer.
If two owners are listed in the registration certificate (e.g. spouses), both must sign. There is one copy per party, so three copies with two sellers. You can check a PESEL with the PESEL validator and a business number with the NIP validator.
PCC tax: 2% within 14 days
A buyer purchasing a car from a private person pays civil law transactions tax (PCC) of 2% of the car's market value. The PCC-3 return must be filed and the tax paid within 14 days of signing, which you can do online via e-Urząd Skarbowy. Example: a car bought for PLN 32,500 means PLN 650 of PCC, rounded to full złoty. No PCC is due when the market value is up to PLN 1,000, when you buy from a business with a VAT invoice, or when you buy abroad. The tax office may challenge a price far below market value, so if the car is cheap because of damage, describe it in the agreement.

The compulsory third-party insurance (OC) passes to the buyer with the car. The buyer can cancel it at any time or keep it until it expires; it does not renew automatically. Late notification or registration can lead to an administrative fine. Before buying, check the car's history at historiapojazdu.gov.pl (you need the VIN, registration number and date of first registration).
